Stockton Bankruptcy Attorney Alia Khan Abedelal Explains the California Means Test for Chapter 7 Eligibility
STOCKTON, CA – Individuals and families in California’s Central Valley exploring debt relief may qualify for Chapter 7 bankruptcy through a federal income formula known as the means test, which evaluates household income against state median thresholds before allowing a case to proceed. Stockton bankruptcy attorney Alia Khan Abedelal of Khan Law (https://akhanlawoffices.com/california-means-test-chapter-7/) explains how the California means test works and what filers need to know to determine their eligibility.
According to Stockton bankruptcy attorney Alia Khan Abedelal, the means test begins by comparing average monthly income over the prior six calendar months to published California median income figures specific to the filer’s household size. California’s median income thresholds rank among the highest in the country, which means a meaningful share of Central Valley residents qualify at the first step of the analysis. “Many people assume they earn too much to file Chapter 7 when a proper expense analysis would tell a very different story,” Abedelal explains.
Stockton bankruptcy attorney Alia Khan Abedelal notes that filers who exceed the state median are not automatically disqualified and must instead complete a second calculation that subtracts allowable expenses from their income. These deductions include IRS National Standards for everyday living costs, IRS Local Standards specific to the filer’s California county for housing, utilities, and transportation, plus actual payments for secured debts, taxes, and other qualifying obligations. If the remaining monthly disposable income multiplied by 60 falls below the federal abuse thresholds under 11 U.S.C. § 707(b)(2), the filer may still proceed with Chapter 7.
Attorney Abedelal also highlights important income exclusions that benefit retirees and disabled individuals. Social Security benefits are explicitly excluded from current monthly income under 11 U.S.C. § 101(10A), which can significantly affect eligibility for those whose primary income comes from government benefits. Certain veterans receiving VA or Department of Defense disability pay may receive additional protections under the Honoring American Veterans in Extreme Need Act of 2019, which excludes qualifying benefits from the income calculation entirely.
The means test is completed on Official Bankruptcy Form 122A-1, which every individual Chapter 7 filer must submit with their petition, and on Form 122A-2 if above-median income is confirmed. The two forms together determine whether a presumption of abuse arises and whether the case may proceed. Khan Law handles means test calculations, document preparation, and court filings for the U.S. Bankruptcy Court for the Eastern District of California, which serves San Joaquin County from its Sacramento location.
Filers who do not pass the means test retain other options. The most common alternative is Chapter 13 bankruptcy, which allows above-median income filers to propose a three-to-five year repayment plan, with qualifying debts discharged at the end. Strategic timing of the filing date may also shift results, since the means test uses a six-month lookback period and a recent income reduction may bring a filer under the median on a subsequent attempt. “Courts track compliance closely and can re-sentence for non-compliance,” Abedelal notes, “which is why understanding all available options before filing is so important.”
Khan Law has guided individuals and families through Chapter 7 bankruptcy throughout the Central Valley since 2007. For those navigating debt relief options in San Joaquin County, Stanislaus County, or the Sacramento area, consulting a bankruptcy attorney familiar with Eastern District practices may help ensure the means test is accurately calculated and defensible.
